Terms of Use

These Terms of Use ("Terms") govern your use of the Focus Labs website, mobile application, and related services (collectively, the "Services").

Focus Labs is currently operated by individuals based in Texas, United States. In these Terms, "Focus Labs," "we," "us," and "our" refer to the people operating the Services.

By creating an account, downloading the app, or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use Focus Labs.

By using the Services, you represent that:

• You are at least 13 years old;
• The information you provide is accurate;
• You have the legal ability to agree to these Terms;
• You will comply with these Terms and applicable law.

Users under 13 may not create or use an account. If we learn that an account belongs to a user under 13, we may suspend or delete the account and associated information.

2. Focus Labs Is a Productivity Platform

Focus Labs provides tools that may include study sessions, timelapses, productivity tracking, streaks, badges, profiles, social feeds, follower features, contact matching, and related features.

Focus Labs is not a school, employer, medical provider, therapist, emergency service, or guarantee of productivity results.

You are responsible for your own decisions, time management, academic work, and use of the Services.

3. Your Account

You are responsible for:

• Keeping your login credentials secure;
• Maintaining accurate account information;
• All activity that occurs through your account;
• Promptly notifying us if you believe your account was accessed without authorization.

You may not:

• Share your account credentials with another person;
• Create an account using false information;
• Impersonate another person or organization;
• Create accounts to evade a suspension, block, or enforcement action;
• Sell, rent, transfer, or give another person access to your account.

We may suspend, restrict, or terminate accounts that violate these Terms or create safety, legal, security, or operational risks.

4. User Content

"User Content" means content you submit, upload, post, create, or share through Focus Labs, including timelapses, thumbnails, profile photos, usernames, session labels, reactions, reports, and other content.

You retain ownership of your User Content.

However, when you post or upload User Content, you grant Focus Labs a limited, worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, format, display, distribute, and otherwise use that User Content solely as necessary to:

• Operate and provide the Services;
• Display your content according to your selected privacy settings;
• Maintain security and prevent abuse;
• Investigate reports and enforce these Terms;
• Improve and maintain the Services;
• Comply with legal obligations.

This license ends when your User Content is deleted from the Services, except to the extent the content remains in temporary backups, is retained for security or legal purposes, or has been independently shared by another user outside the Services.

5. Your Responsibility for Posted Content

You are responsible for your User Content and for making sure you have the right to post it.

You must not upload or post content that:

• Shows another person without their permission;
• Includes private documents, private messages, passwords, account details, phone numbers, addresses, school schedules, or other sensitive information;
• Reveals a person's location, home, school, workplace, or routine in a way that could create a safety risk;
• Infringes another person's copyright, trademark, privacy, publicity, or other rights;
• Is unlawful, deceptive, fraudulent, or misleading;
• Is sexually explicit, exploitative, or involves minors in sexualized content;
• Threatens, harasses, bullies, stalks, or intimidates another person;
• Promotes self-harm, violence, hate, discrimination, or illegal activity;
• Contains spam, scams, unauthorized advertising, or phishing;
• Impersonates another person or organization.

Focus Labs may remove User Content or restrict access to it at any time if we believe it violates these Terms, creates a safety risk, or is otherwise harmful to users or the Services.

6. Timelapses and Privacy Settings

Focus Labs may let you create timelapses using your device camera.

You are responsible for reviewing a timelapse before posting it. Timelapses may unintentionally show your face, room, screen, documents, family members, classmates, private information, or location clues.

You control whether a session is private or shared through available in-app settings. Shared content may be visible to followers or other users based on your profile and post settings.

Do not assume that shared content is confidential.

Focus Labs may offer a blur feature, but blur is not guaranteed to remove all identifying information or make your content anonymous.

7. Social Features, Discovery, and Blocking

Focus Labs may allow users to:

• Follow other users;
• View profiles and shared sessions;
• Search for users by username or display name;
• Receive user recommendations;
• React to shared content;
• Match with existing users through optional contact matching;
• Block other users;
• Report users or content.

You may block another user through available in-app tools. Blocking may limit the blocked user's ability to interact with or view your profile and content, but no block feature can guarantee that another person will not access information they previously saw, copied, saved, or shared elsewhere.

You may not use social features to harass, monitor, exploit, contact, or target another person.

8. Contact Matching

Contact matching is optional.

If you choose to use it and grant permission, Focus Labs may process phone numbers from your contacts to identify contacts who already use Focus Labs. Contact names are not uploaded for matching, and Focus Labs does not retain your address book from the sync process.

You must not use contact matching to stalk, harass, scrape, profile, or target other people.

You can skip contact matching or revoke contact permission through your device settings.

9. Reports, Moderation, and Enforcement

Focus Labs may provide reporting tools for content, users, or conduct that violates these Terms.

We may review reports, investigate activity, remove content, limit visibility, disable features, suspend accounts, terminate accounts, or take other action that we believe is necessary to protect users, enforce these Terms, comply with law, or protect the Services.

We are not required to review all User Content, and we cannot guarantee that harmful, inaccurate, or offensive content will be removed immediately.

If you believe we made a mistake regarding a moderation decision, contact studyroomdevs@gmail.com with enough information for us to review the issue.

10. Prohibited Conduct

You may not:

• Use the Services for illegal purposes;
• Attempt to bypass age restrictions, blocks, privacy controls, rate limits, or security measures;
• Access another user's account or data without permission;
• Scrape, harvest, crawl, or collect user information from the Services;
• Reverse engineer, decompile, or attempt to extract source code except where law prohibits restricting that right;
• Interfere with the Services, servers, APIs, storage, or other users' access;
• Upload malware, malicious code, bots, or automated scripts;
• Manipulate streaks, rankings, badges, reactions, views, followers, or other product metrics;
• Use the Services to send spam, scams, or unauthorized promotional material;
• Use the Services to build or train a competing product using Focus Labs data or content without written permission;
• Violate another person's privacy, intellectual-property rights, or rights of publicity.

11. Intellectual Property

Focus Labs and its licensors own the Services, including the app design, software, branding, logos, features, text, graphics, and other materials, excluding User Content.

Subject to these Terms, Focus Labs grants you a limited, personal, revocable, non-transferable, non-sublicensable license to use the Services for their intended purpose.

You may not copy, modify, distribute, sell, lease, license, publicly display, or create derivative works from the Services except with our written permission or as allowed by law.

12. Feedback

If you provide suggestions, ideas, feedback, or recommendations about Focus Labs, you grant us the right to use that feedback without restriction or compensation to you.

13. Third-Party Services

The Services may rely on or link to third-party services, including Apple, Google, Supabase, Expo, app stores, and other providers.

Your use of third-party services may be governed by their own terms and privacy policies. Focus Labs is not responsible for third-party services that we do not control.

14. Service Availability and Changes

We may change, suspend, discontinue, or remove any feature of the Services at any time.

We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or compatible with every device.

We may update the app automatically through app stores or require an update to continue using certain features.

15. No Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUS LABS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT FOCUS LABS WILL IMPROVE YOUR PRODUCTIVITY, ACADEMIC PERFORMANCE, FOCUS, OR RESULTS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUS LABS AND THE INDIVIDUALS OPERATING IT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO FOCUS LABS FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

2. ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some portions of this section may not apply to you.

17. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Focus Labs and the individuals operating it from claims, damages, liabilities, losses, and expenses arising out of or related to:

• Your use of the Services;
• Your User Content;
• Your violation of these Terms;
• Your violation of another person's rights;
• Your violation of applicable law.

18. Termination

You may stop using the Services at any time.

You may delete your account in the app through:

Profile → Settings → Account → Delete Account

We may suspend or terminate your account or access to the Services at any time if we reasonably believe you violated these Terms, created risk for other users, or used the Services unlawfully or abusively.

Sections that by their nature should survive termination will survive, including intellectual-property, disclaimer, limitation-of-liability, indemnification, dispute, and governing-law provisions.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Texas, unless applicable law requires otherwise.

Nothing in these Terms limits consumer rights that cannot legally be waived.

20. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the Effective Date and may provide notice through the app, website, email, or another reasonable method.

Your continued use of Focus Labs after updated Terms become effective means you accept the revised Terms.
